Calculating Your Auto Claim Pain and Suffering

One of the most important parts of any auto accident settlement is the pain and suffering.  While special damages will compensate you for time off work, a damaged car, and your medical bills, all things that you have direct financial number attached to them, general damages like pain and suffering compensate you for the other damages to your life that don’t have a specific financial number.  Here are a few tips on how to figure out the amount you should be getting.

Unfortunately, while some books and websites claim to calculate the amount of pain and suffering that you can expect to receive it is a very complex number.  There are many things that can be used to determine it.   The severity of injuries is the largest component, so to an extent, the higher your hospital bills, the larger amount of money you can hope for with your auto claim pain and suffering.

However, the size of your medical bills also has to be balanced with the effect that the accident has had on your quality of life.  Some injuries, soft tissue damage to elderly passengers for example, might not require much in the way of hospital bills, but they can significantly affect your life or ability to work.  Others can have higher hospital bills, but not affect your quality of life as much, resulting in slightly lower pain and suffering damages.

Making things even more complicated, the area that you live in can determine the amount that you will get as a settlement as well.  Juries in different areas are my sympathetic to people than others and some states have different laws than others regarding the maximum damages that you can seek.

Because of all this complexity, if you do have a lot of pain and suffering damages at stake in your settlement, you should seek out a lawyer to try your case.  Only with a professional on your side will you be sure that you have receive the money that you are owed.
