How to Follow Through On A Motorcycle Accident Claim
No good can come out of a motorcycle accident. However, receiving compensation for the accident can help relieve the financial and legal burdens that are often associated with personal injuries. Getting this compensation isn’t as easy as simply calling your insurance company and telling them that you weren’t responsible for your injuries. However, there is a legal procedure you can follow to make sure that you receive the compensation that you need. By law, a motorcycle accident is considered to be equal to any other vehicular crash. This means you will need to follow the exact same procedure for getting compensation as you would for any other vehicle involved in a similar accident.
This means that first, you need to be able to have evidence that the other party is partially or directly responsible for all personal and material losses resulting from the accident. If you’re solely responsible for the accident, then your expenses will still be covered; however, your insurance rates would rise significantly.
Immediately after the collision, make sure that you know what other vehicles were involved with the crash. This includes knowing the damages to the other vehicles, as well as their license plate numbers and the personal information of everybody else involved. If you can find any eyewitnesses to the crash, then it would also be a good idea to get their information. This way, you can have people to back up your claim. When the authorities arrive on the scene, do not claim any responsibility for the incident, unless you know it was truly your fault. If you do claim responsibility, your insurance company will bear the financial brunt; directly resulting in an insurance rate increase.
Once you are home, be sure to write down your personal claim of the incident; a first-hand account of what happened. However, this will only be helpful to your case if there is a witness present. If no witness is present, your claim may not be deemed as reliable; personal claims are typically biased accounts. In the end, the witness’ recollections are what really matters. But if neither party is proven to be guilty, then nobody owes anyone anything under the “no-fault” policy. This will make it so that each party covers their own personal expenses.
If your injury disables you from going to work, then be sure to add the expense of lost wages to your claim as well. If your policy will not cover lost wages, turn to your health care provider to see if lost wage expenses are covered under them. Typically, health care providers will cover these expenses.
Regardless of what happens, your hospital expenses will be paid for up to a certain point. Be sure to cover the deductible, as your insurance company will not provide any aid until it is taken care of. Also, don’t forget that the difference between the overall expense of the incident and the limit on your insurance policy will need to be covered by you alone. If this procedure is followed, then you are guaranteed a good chance of receiving the compensation you need. Motorcycle accident claims should be considered if you are seriously hurt or affected in a vehicular accident that is not your fault.
